Terms and Conditions of Platform Use
1. Scope
These Terms and Conditions apply to the use of the website vistaraxr.com, the platform app.vistaraxr.com, and all related services provided by Sinaholz GmbH. By accessing this website or using the software platform, you agree to be bound by these terms.
2. SaaS Subscriptions & Reseller Terms
Vistara provides a B2B Software-as-a-Service (SaaS) tool for 3D virtual tour agencies.
- Workspace Quotas: Subscription tiers (Free, Starter, Studio) limit the number of client seats, Points (Kiosks), active hotspots, storage limits, and monthly bandwidth. Exceeding these quotas requires a plan upgrade.
- Agency Reseller Rights: Agencies subscribing to eligible reseller tiers are granted permission to create white-labeled client studio portals, providing secure access accounts to their respective clients.
- Workspace Takedown & Pausing: In the event of unpaid client invoices, billing defaults, or terms violations, Vistara provides agencies with a one-click dashboard control to immediately pause and restrict access to the client's active tour points. Sinaholz GmbH is not liable for client business disruptions resulting from agency-initiated tour pausing.
3. Copyright
The content and works created by the site operators on these pages are subject to German copyright law. Duplication, processing, distribution, or any form of commercialization of such material beyond the scope of the copyright law shall require the prior written consent of its respective author or creator.
4. Liability
As a service provider, we are responsible for our own content on these pages in accordance with general laws pursuant to ยง 7 Sect. 1 of the German Telemedia Act (TMG). However, we are not obligated to monitor transmitted or stored third-party information.
Sinaholz GmbH provides the Vistara CMS to facilitate tour hotspots content updates. The responsibility for all uploaded assets (images, video links, pdf brochures, glTF models) lies solely with the subscribing agency and their clients.
